mongie on his 3rd trial


Singer MC Mong, who was recently charged with suspicions of intentionally extracting his teeth in order to dodge his military draft, attended his third trial on December 20th at the 519th Seoul Central District Court.
The six-hour-long trial included the testimony of five witnesses, all of whom were MC Mong’s dentists.  The day’s hearing focused on interrogating the issue behind the validity of the 46th and 47th teeth extractions.  All five dentists present were his dentists in 2004.

At the second hearing, all five revealed that MC Mong’s teeth were already deteriorated, causing him to be in great pain. “A first glance with the naked eye would have shown that they were in a bad condition,” they stated.

When asked by the judge as to why he was not consistent in visiting one dentist, MC Mong could not come up with an answer.  Furthermore, after it was revealed that there were no records of his extractions and consultation fees, the dentist in question answered, “We had just installed a new electronic register so there was a moment of confusion.  Regarding the consultation fees, the nurses did not ask MC Mong to pay because he is MC Mong (a celebrity).”

When asked whether MC Mong made any mention of draft dodging during the time of his teeth extractions, the witnesses provided answers that were different from those recorded during the investigation.

In the investigations, they had stated, “We discussed his draft problems and he intentionally extracted his teeth in order to dodge it.”  However, once in the court, witnesses stated, “The police investigations were held in a pressuring and forceful environment.  They led us to reply in the manner they wanted.”
After the trial was held, MC Mong refused to make any further statements and returned home.  He wrote on his mini-homepage, “I will wait for the next trial.  I cannot even breathe, but I request that you wait for me.

MC Mong updates (trial #3)

MC Mong returned to court on December 20th as the trial continues with more questioning of the dentists involved in the case.  Here is a brief summary (by shyangz) of the main points in trial #3, terms and jargons slightly difficult to translate so please feel free to add or correct our interpretation.  The next trial (#4) has been scheduled for January 24th.

“Prosecutors 51 points vs Mong 48 points”…where’s the key to this cutting point regarding the teeth extraction charges?

Three witnesses were questioned
1. Mr Lee (A, 2004. 08) who introduced the dentist in question to MC Mong
2. Mr Lee (B, 2006. 12), a dentist who issues military-related medical diagnosis
3. Mr Lee (C, 2007. 03), formerly a military doctor from Military Manpower Association’s Physical Examination Center

The main point of contention in the 3rd trial is tooth no. 15.
- the statute of limitations on this tooth has expired, thus this tooth did not receive as much impact in this case.
- but its partial existence was raised in the trial, thus prosecutors say it may still exist although it was regarded as part of of the missing teeth (together with tooth no. 35) that could achieve military exemption.
- the prosecutors asserted that if tooth no. 15 existed, then MC Mong can achieve as much as 51 points and not be able to receive military exemption. 

In this trial, there’s no convincing evidence from both sides, but instead, more charges have appeared. After the trial, 3 issues can be raise:

◆ Issue 1. A new secret card (I think this is a pun by the reporter) has been presented in the trial. Dentist Mr. Lee (B) said he certainly saw the existence of tooth no. 15 but military doctor Mr Lee (C) defined it as missing. If tooth no. 15 did exist, it could have added as many as 3 more points to MC Mong’s physical exam results. The absence of this tooth, together with tooth no. 35, may have enabled MC Mong to achieve a score below 50 thereby receiving military exemption.

Mr Lee (C) – I made a mistake at that time. The tooth could be seen on the panoramic Xray but I said it didn’t. It was a wrong diagnosis and Shin Dong Hyun’s points for functional teeth could have increased from 42 points to 45 points (dental functions are stated as fine when you exceed 45 points).  Even though the tooth existed it was infected so I defined it as missing. I agree with the prosecutors’ stand. As long as the root of the tooth exists, 1-2 points can be gained (for the physical exam).

Mr Lee (B) – 2 premolar teeth on the right of his upper jaw was recorded to be infected. The teeth were not visible to the eye, but roots were visible in X ray records. It was recorded that the roots were infected.
Prosecutors – Mr Lee (B) said the said he saw the tooth, Mr Lee (C) said he didn’t. There’s a possibility the presence of tooth no. 15 could have allowed MC Mong to receive 48 points for healthy teeth functions.

◆ Issue 2. Timing and sequencing of events:  Extract tooth no. 35 then get a diagnosis for military physical examination then go for military physical examination. MC Mong took 3 months to do this. Prosecutors said it happened too fast and suspect it is because he’s trying to evade military service. But the defense said that these 3 occurences were unrelated and the prosecutors’ assertions were unfounded.

◆ Issue 3. The use of violence tactics by police were raised again. All 3 witnesses said their confessions to the police were partially exaggerated and distorted. MC Mong’s lawyers said that police interrogations were one-sided and carried out by threatening witnesses. But the prosecutors questioned an investigator for this case and made a strong rebuttal that this is a misunderstanding.

On Friday (Dec. 17th), it was announced that the requirements to get an exemption has been made tougher. To qualify for an exemption, a man must have at least 16 teeth missing of the usual 28 teeth, raised from the 9-10 missing teeth that used to qualify for an exemption. This will take effect starting February 14, 2011.  

There were other changes as well, making it tougher to qualify for an exemption, including if you have bad eyesight as well have had back/disc surgery, but those aren’t mentioned in this article.

In addition, MBC, following in the footsteps of KBS, has officially banned MC Mong. He’s one of 29 people banned from the broadcast company.  No word on whether this is a temporary ban as what KBS is asserting.



Poor mongie to face all this tiring moments...pls remember mong that we always support u and will waiting for you dear...i just remember, few nights back, i dreamed about ur come back in 1N2D...urmmm, maybe true right??let's hope for the best!!!

mongie...really want to cry in the office today after read your statement on the ongoing trial...





MC Mong has never spoken out since his trials, but he finally released a statement towards his fans on the 30th.

On his Cyworld, he wrote, “As someone who received so much love that I did not deserve, my world’s laws are your words. I’m not going through trials because I feel cheated or because I want to get my popularity back. Once the trials are over, I will await your judgment. I don’t even have room to breathe right now. I beg you to wait for me just a little more.”

MC Mong.....really miss him...berbunga riang ati ini bile bace n3 pasal kes mahkamah die ni...aku percaya mong xsalah...+ aku sokong die..mesti keje org yg jeles sibuk nak jatuhkan die ni!!!

aku rase kite rakyat m'sia kena bersyukur sbb kita xdipaksa tuk enlistment cam dorang kat korea nu..sume lelaki wajib masuk selama lebih kuang 18bulan...jd mcm tentera bebtul tuh...kite nye PLKN tuh, dah la dipilih secara random, model latihan simple + sekejap..3 bulan je.. itu pun ade org yg nak ngelak..
tp klu da kena wat gak serupe deme kat negara lain tuh xke korang nangis??

i believe mongie do not do it intentionally..to pull out his own teeth to avoid enlistment as accused by police!the tooth was damaged and not the healthy one okay...beside, police is the one who manipulated the facts + force the dentists to put the charges on him...Not even single dentist agreed or admit that mong bribe or discuss about avoiding enlistment by pulled out his teeth...

really miss him on 1n2d, although not handsome or smart like Lee Seunggi, but his cheerful, mindless n crazy action, disturbing hodong although end up beaten by hodong, his love towards frens and fans and everything about him really make me sick missing him...i'm not really xcited to watch1n2d rite now coz his not there!

i'm really enjoy listening to kpop music but his album is the only one i bought direct from Korea!!!not even suju, 2pm or lee seunggi albums or any popular kpop artist albums...i don't know y but i really love his music.

MC Mong had his second trial on the afternoon of the 29th, and all of his dentists testified that he has never asked them anything about trying to avoid enlistment, which was what he was accused of.

Five dentists that he had visited testified at this hearing. The dentists asserted that they never told the police that MC Mong had asked them about enlistment evasion, and that the police had added that part themselves.

The first dentist explained that MC Mong visited his hospital because he learned that the hospital opens late at night. MC Mong came to him complaining about acute pain in tooth 47 and got nerve treatment for it. The first dentist testified that MC Mong had never even brought up the subject of enlistment to him and that MC Mong had never even asked him to pull the tooth out.

The second dentist testified that he suggested MC Mong to another doctor because his teeth were in extremely bad condition, that MC Mong never asked about enlistment evasion, and that MC Mong never asked him about teeth 46 and 47, which are the two teeth that are in question. He explained that the detective almost forced a lie out of him and that the truth was different from what the detective wrote down in the police report.

The third dentist explained that he had ran tests on MC Mong but never treated MC Mong. He also testified that MC Mong had never asked him about enlistment evasion and also confirmed that MC Mong never asked about teeth 46 and 47. He explained that the police made him sign the testimony in confusion, so he never got to look over what he was signing.

The fourth dentist testified that MC Mong came to him saying that he ate 10 painkillers and told him that tooth 47 was hurting him. However, he testified that MC Mong had never asked about enlistment evasion. Also, in the police report he is reported to have said that “MC Mong asked forcefully about removing tooth 47.” He explained that he never put in the word “forcefully” in his account, and he said that he had never heard MC Mong ask about enlistment evasion and wanted to know why the police report reported him as saying so.

The last dentist was the one who took out teeth 46 and 47. He explained that tooth 47 was acutely damaged, so he pulled it out. He pulled out 46 because there was a hole in the tooth, and explained that he could not know why the hole was there. He also explained that MC Mong had not taken good care of his teeth and most of his teeth needed either care or removal. He also explained that the police told him to write in words such as “forceful” and “intense” into his account, and that he was bothered about it constantly when he did not. He explained that he had never talked to MC Mong about enlistment evasion. He explained that unlike the reports, he had never gotten money from MC Mong for taken the teeth out, and that the reason he took the teeth out wasn’t from MC Mong’s request.

Seems like MC Mong was telling the truth, after all, and he really didn’t take his teeth out just to avoid enlistment. This has changed many fans’ views and many have commented that they don’t know who to trust anymore. And if MC Mong really had been speaking the truth all this time, it means that he has been hurt badly for no reason. It also brings up another serious question about the corruption of the police.
